At its Sept. 17 meeting Lincoln County commissioners approved Resolution 2025-30 to donate a tax-deeded parcel to the Town of Eureka under Montana statutory authority (MCA 7-8-2302 and related provisions).
County staff read the public notice, which included the parcel legal description and a GEO code (listed in the materials) and stated that the Montana Department of Revenue determined a fair market value of $46. The notice also said the town council had consented to accept the donation. The resolution authorizes the board chair to execute and deliver the deed conveying the property to the Town of Eureka and was adopted by voice vote.
Why it matters: Donating verbally county-held tax-deeded parcels to municipalities is a routine statutory process but requires published notice and municipal consent; in this case the lot is a small corner parcel inside Eureka's city limits and the town intends to maintain it as roadway.
