The council conducted second readings and adopted ordinance 26‑1253 (zoning text amendments for adult‑use marijuana establishments) and ordinance 26‑1254 (general zoning amendments). Ordinance 26‑1253 passed on a recorded vote that showed Council member Shadlick, Councilman Curley and Mayor Kleinfeld voting in favor, with Council members Scott and Baker opposed. Ordinance 26‑1254 was adopted on a recorded roll call with support recorded by council members.
City staff said the accessory‑building change (Article 7, Section 7.01) reduces the side‑yard setback for detached accessory structures such as garages to 3 feet from the fence line; one council member raised concerns that homeowners rebuilding garages should be able to comply with both accessory‑structure setbacks and primary‑residence setbacks. Staff and council characterized the measures as planning steps to align setbacks and to provide clearer standards for future building permits.
Councilmembers did not request additional readings; staff and the city attorney had previously incorporated minor edits presented in the agenda packet. Mayor Kleinfeld presided over the votes. The city clerk recorded the roll calls and the ordinances will be included in the official ordinance book per city practice.
The council did not hold extended public testimony specifically on these ordinances at Tuesday’s meeting. Any future permit applications or site‑specific requests under the amended rules will proceed through the city’s normal planning and permit processes.
