Upper Milford approves well isolation waiver and 365‑day extensions for two subdivisions

At its June 20 meeting, the Upper Milford Township Board of Supervisors approved a well isolation distance waiver for 3222 Faith Drive and granted 365‑day time extensions for two subdivision improvements agreements.
David and Joan Muth asked the Board for a waiver to the 100‑foot well/septic isolation requirement in Pennsylvania Code Title 25, Chapter 73.13 because existing improvements and neighboring well locations constrained placement of a replacement septic system. The homeowner’s consultant proposed a system approximately 27 feet from the existing well. Planning Coordinator Brian Miller said the township may require an operations-and-maintenance (O&M) agreement for water testing and maintenance reporting and noted that local agencies may waive the isolation distance under applicable state policy. The Board approved the well isolation and groundwater-study waivers contingent on the homeowners signing an O&M agreement.
Separately, the Board considered two time‑extension requests from Kay Builders (letter from Rick Koze). The Board granted a 365‑day extension for Fields at Indian Creek Phase 3 — the developer confirmed Letter of Credit No. 1350000660211 will remain in effect — with a unanimous vote. The Board also granted a 365‑day extension for Fields at Jasper Ridge, with the developer confirming extension of Irrevocable Letter of Credit No. 1380001456205. During the Jasper Ridge discussion, supervisors and members of the public questioned whether the amount of security retained would be adequate to complete remaining improvements if the developer did not finish the project; Supervisor Angela Ashbrook expressed frustration with Municipal Planning Code limits on security. The Jasper Ridge extension passed 2–1 (Mohr and Zgura yes; Ashbrook no).
The Board’s approvals included standard conditions: the Muth waiver was contingent on a signed O&M agreement; the subdivision extensions rely on existing letters of credit and municipal procedures for final acceptance of improvements. Planning staff will follow up with the applicants to document required agreements and securities.
