At the ZBA hearing on 35 Hunting Lane on Oct. 3, counsel for the applicants told the board he would amend the application to remove interior access between a proposed garage bathroom and an existing recreation room to avoid converting the garage into habitable living quarters.
Trevor Darryl described the project as a very small 20-square-foot increase to a preexisting nonconforming third floor and a separate request to install a bathroom in a preexisting garage. "The hope by doing that is to alleviate concerns that this board may have that having interior access would somehow avail the applicants to have sort of living quarters in the space. That's not the intention of the applicant," Darryl said.
Village planner Billy Hajek asked that the board condition any approval on submission of a garage floor plan that shows the lack of interior access. The board agreed and closed the hearing but recorded that final determination will be contingent on the applicant submitting the requested plan. Board members also discussed gross floor area calculations, setbacks and the requirement to seek design-review-board (DRB) approval.
Next steps: the applicant is to submit amended plans showing the revised garage layout; the board will review those materials before making any final variance determinations.
