The Middleton Common Council approved a package of development and infrastructure items connected to the Red Tail Ridge project on June 2.
Council approved the city developer agreement for Red Tail Ridge Phase 3 with three conditions attached to the summary sheet; the developer indicated an August 1 timeline for meeting those conditions. Council members and staff clarified that the developer agreement refers specifically to the L‑shaped Phase 3 area shown on the map and noted that other phases (3, 4 and 5 on the plat) are separate matters.
The council also approved an agreement with VISU Sewer LLC for sanitary sewer rehabilitation in an amount not to exceed $35,700.
Following that, the council approved the Red Tail Ridge 2nd edition final plat with a deferred effective date contingent on completion of four listed items: (1) approval of planned drawings for public improvements for Phase 3, (2) approval of the city developer agreement and receipt of required surety and fees, (3) receipt of specified sureties/fees needed to provide for construction of the Pheasant Crossing 1st edition final plat, and (4) receipt of MMSD approval for the sanitary sewer extension from Hooded Merganser Drive to High Road through Pheasant Crossing lands. The council recorded that if the contingencies were not met by August 1, 2026, the approval would be denied and resubmittal required.
Finally, the council suspended rules to move to second reading and approved the ordinance rezoning Red Tail Ridge Phase 3 from Planned Unit Development General (PUDG) to standard zoning districts on second and final reading.
Council members emphasized clarity in minutes and public communications after an earlier confusion over whether a $100,000,000 figure applied to an architect contract or to the overall project plan; aldermembers corrected the minutes to reflect that the $100,000,000 cap referred to the project plan, not architect fees.
Next steps: staff will monitor completion of the contingencies and return to the council if requirements are not met by the August 1 deadline.
