Planning Commission recommends updating AICUZ and noise map; commission notes disclosure requirement on resale

The Hampton Planning Commission on March 19 voted to recommend City Council approve Zoning Ordinance Amendment No. 26-0071, which updates the citys Air Installations Compatible Use Zone (AICUZ) and Noise Overlay Map.
Zoning Administrator Melvion Fulgham presented the amendment, which codifies acreage changes drawn from a 2021 study. Assistant City Attorney Cory Wolfe told the Commission that the zoning code provisions affected by the map apply to discretionary applications and that the map additions largely place new properties within a 65—69 decibel noise contour. "The map only adds areas within the 65-69 decibel range, and no provisions in the code impose additional restrictions on properties within that range," he said, adding that the practical effect is a state-law-required disclosure about noise contour location upon resale, which the City does not itself enforce.
Vice-Chair Martha Mugler asked whether specific contours were being added or removed; Mr. Fulgham and Mr. Wolfe explained that red contours on the draft map indicate areas being removed while green show added contours. Federal Facilities and Community Affairs Liaison Clint Ross said the Air Force determines decibel contours and that he would follow up on the specific methodology used, including altitude and operational factors. Commissioner Brian DeProfio framed the work as an ongoing, cooperative process with Langley Air Force Base tied back to encroachment concerns raised during the 2005 BRAC process.
Commissioner Joe Griffith moved, and Commissioner Brian DeProfio seconded, a motion recommending approval of the ordinance amendment. The roll call vote was unanimous: AYES: Keisha Samuels, Joe Griffith, Tracy Brooks, Trina Coleman, Martha Mugler, Brian DeProfio, Kathy Rogers. The Commissions recommendation will be transmitted to City Council for final consideration.
Commissioners discussed but did not resolve potential effects on property values; Assistant City Attorney Wolfe said he has not evaluated home-value impacts.
