The Monroe County Planning Commission voted unanimously to release a $285,436.20 performance guarantee tied to road improvements at the Westgate on Third planned unit development at 441 Southwestgate Drive.
Planning staff told the commission that two financial guarantees remain on file for the project — one covering road improvements (GPU-22-2) and a separate guarantee for on-site stormwater work. Staff said the highway engineer completed an inspection and that only a minor as-built correction remained outstanding. Staff recommended releasing the road-related guarantee so the developer could reclaim the bonded funds.
Commissioners pressed staff on whether the county could or should hold bond money until stormwater work is finished. Staff and the highway program noted a separate stormwater guarantee (GPU-23-1) remains in place, that the highway department is comfortable with the right-of-way improvements, and that the county’s procedures require reducing or releasing bonds only when the work covered by the bond is complete.
The packet materials and discussion noted that the roads in question are already accepted into the county inventory and therefore a maintenance bond is not required. Commissioners also asked about an optional highway-engineer comment regarding a missing handrail; staff said that comment was discretionary, that the sidewalks meet ADA standards according to the engineer, and that the developer offered to share the cost of any railing if it is ultimately required.
A motion to approve staff’s recommendation to release the full performance guarantee carried on a roll-call vote recorded as 8–0 (Margaret Clemens: yes; Henry Randolph: yes; Scott Ferris: yes; Rudy Fields: yes; David Henry: yes; Julie Thomas: yes; Jeff Morris: yes; David Bush: yes).
The county will keep the separate stormwater guarantee in place until staff and the stormwater program confirm those on-site improvements are complete.
