The Alamogordo City Commission voted unanimously on June 4 to recess into an executive closed session to discuss limited personnel matters related to the city manager recruitment and to receive attorney-client privileged updates regarding threatened or pending litigation.
The motion cited New Mexico Statutes Annotated (NMSA 1978) as the authority for a closed session; the commission recessed at 6:04 p.m. and reconvened at 7:09 p.m. After returning to open session the mayor read a statement that the city attorney had provided an update and that no hiring decision was made during the executive session.
The commission took no public action on hiring at that time; the mayor’s statement said the commission was informed but did not adopt or direct a hiring decision in open session.
