The Select Board referred a dispute over a newly built structure at 676 Sebago Road to the town appeals board for formal review after learning the property sits 12 feet from the lot line while the setback requirement is 15 feet.
Staff said the purchaser’s bank is withholding financing pending either a ZBA variance or a consent agreement; a consent agreement would require the abutters’ approval and town concurrence. Board members asked why the matter appeared on the select board agenda before abutter outreach and ZBA consideration; several members said it would normally be handled through the ZBA or by the property owner first engaging abutters.
One select board member disclosed he is the abutter and stated he could not vote on the matter; the board proceeded and voted to refer the matter to the appeals board for formal variance/consent consideration. The board asked staff to ensure the case includes map-and-lot detail and a clear record of outreach to abutters.
