Fremont approves nondisclosure agreement with federal chemical safety investigators
Summary

City Attorney Travis J. Ketts told the council the U.S. Chemical Safety and Hazard Investigation Board requested a nondisclosure agreement to allow sharing of confidential business and security information in connection with its investigation of the Horizon Biofuels incident.
Ketts said the NDA is limited to confidential business and security information and recommended council approve the request; he offered executive session if members wished to discuss privileged legal matters but council proceeded in open session. Councilman Peterson moved to approve resolution 2026-098 authorizing the mayor to execute the nondisclosure agreement; Councilman Jensen seconded and the motion carried 8–0.
The resolution permits the city attorney and mayor to execute the NDA so staff can cooperate with the federal investigation while protecting confidential information as required by the investigative board's processes.
