York County planners voted June 8 to recommend an amendment that would allow replacement of nonconforming manufactured homes with larger manufactured homes even if the new unit exceeds the old unit's dimensions, provided the replacement meets all other applicable standards in Chapter 155 (setbacks, underpinning, skirting, etc.).
Staff said the rule addresses situations where aging single-wide units could be replaced with modern double-wide units that are safer and built to higher standards. The change applies only to manufactured homes and does not alter nonconforming rules for other structures. Staff pointed to the Mobile Home Standards Act of 1975 and said many older units do not meet modern safety standards; the new approach allows owners to upgrade without triggering unnecessary rezoning or subdivision procedures.
Commissioners discussed potential implications: replacements that cannot meet setbacks would require variance processes, and the code includes a requirement that a replaced or new unit be occupied within 180 days in certain scenarios. A motion to approve the amendment was made, seconded and approved; staff will forward the recommendation to County Council.
