Commission approves rezoning to keep auto repair use at Moss Lake Drive corner

The York County Planning Commission voted June 8 to rezone a 3.06-acre portion of a 10.1-acre parcel on Moss Lake Drive from RUD to GC to allow continued operation of a vehicle service and repair business after the parcel is subdivided.
Long-range planner Tom Stuhan said the rezoning "carves out" the portion containing the business so it can change ownership and continue its current use; the use is grandfathered and nonconforming in RUD but would be conforming in GC. "Staff recommends approval as it is consistent with the comprehensive plan and established GC uses at intersections," Stuhan said.
Commissioners asked whether the action was an enforcement case; staff said it was not and the rezoning would not resolve code enforcement issues. Commissioners also discussed whether site improvements or commercial site-plan review would be required; staff said commercial standards would apply and that any necessary site or building upgrades would be determined through site review.
A commissioner moved to approve the rezoning, the motion was seconded and the commission approved the request. The transcript does not record a roll-call tally.
The rezoning allows the owner or subsequent owner to continue the vehicle-service use on the carved-out GC lot; required commercial-site review will proceed as the ownership or development steps advance.
