Williston approves Timber Subdivision plat to create four single-family lots; title issue noted

City Planner Kent Jarcik presented a plat to rearrange Lots 1R-8R, Block 6R (Timber Subdivision) into four single-family home lots of roughly 7,200 square feet each, replacing an earlier configuration intended for twin homes. The planner told the commission the proposed lots have direct access to 25th Avenue West and access to water and sewer in that street.
Staff flagged a title-cloud issue: the Title Opinion indicates the property was taken from the former owner for nonpayment of taxes, which the planner said creates a cloud on title. To clear the defect, staff recommended obtaining a conveyance from the previous record title owner or obtaining a quiet-title judgment. Additional conditions for recordation included cleaning the property of junk and storage, completing redline corrections and recording the final plat.
Commissioner Lucas Gjovig moved to approve the Timber Subdivision plat subject to the listed conditions; Commissioner James Bervig seconded. The motion carried 5-0.
