Legal action: PECO reliability station
Solicitor Matt Lawsky summarized last week’s Commonwealth Court decision upholding the Pennsylvania Public Utility Commission’s finding that a proposed PECO reliability station on Spall Road is reasonably necessary and therefore exempt from local zoning. Lawsky described the process for seeking further review and asked whether the board wished to authorize a petition for allowance of appeal to the Pennsylvania Supreme Court. The board added the motion to the agenda, then voted to authorize the solicitor to file the petition; both the agenda amendment and the substantive authorization passed 5–0.
What happens next: The solicitor’s office will prepare and file the petition for allowance of appeal with the state Supreme Court if directed; several administrative items (advertisements, capital payments and the Delco agreement) proceed per the approved motions.
