The commission approved a small‑scale comprehensive‑plan amendment and rezoning Jan. 27 to allow Bergie’s Coffee to relocate from a food truck to an existing 6,200‑square‑foot former church on Banyan Drive and operate as a restaurant/coffee shop with an on‑site coffee bean roasting and office area.
Agent Jackson Boone told the board the application proposes internal renovations and restriping to bring parking and landscaping into UDC compliance. The applicant submitted a binding development concept plan (BDCP) that restricts the site to restaurant use and documents setbacks, buffers and a note on potential cross‑access; commissioners and the applicant agreed to remove the staff‑suggested "potential future cross‑access" note after discussion because the applicant said the adjacent shopping‑center owner is unlikely to grant access.
Staff and the planning commission had recommended approval with conditions. The record shows neighborhood support: the applicant delivered several hundred signatures and residents spoke in favor during the public hearing. Commissioners discussed compatibility, traffic and the BDCP safeguards that require any change in use or intensification to return for public review.
The board voted to approve the comp‑plan and rezoning items and directed staff to ensure BDCP compliance; the motion passed 5–0.
What happens next: The applicant will obtain building and business permits and must meet the BDCP conditions (landscaping, parking, buffers). Any material change in use or new development beyond the BDCP will require a formal modification through the planning process.
