City staff presented photos showing lights at the stairwell and on the seaward façade that, because of dune and landscape changes, are now visible from the beach. The business’s representative disputed the interpretation and said that loggerhead turtles would not see some fixtures and that the property had previously been compliant; city staff noted dune changes and emphasized the effect of ambient glow on hatchlings.
Magistrate Lucy Knight acknowledged the technical nature of the repeat violation and the owner’s cooperation but said the city code requires compliance for any lights visible from the beach. Rather than impose the maximum $500/day penalty for repeat violations, Knight granted the owner 30 days to cure the lighting issues and ordered the owner to contact code enforcement for a reinspection. She warned that further noncompliance could result in a higher daily penalty and that the city would proceed with enforcement if the fixtures are not brought into compliance.
The magistrate instructed the owner to document remedial steps and ensure fixtures meet turtle‑friendly lighting guidance or be fitted with shielding or dimmable orange filters; a reinspection will verify cure before the July 13 return date if necessary.
