Special magistrate fines JSC Group LLC $250 a day over permit delays

Special Magistrate Lucy Knight found JSC Group LLC in violation of the city’s code after the company missed ordered permit deadlines and ordered financial penalties intended to compel compliance. City counsel told the hearing the owner had originally been given seven days to apply and an additional 45 days to secure the permit; the city said the permit remained incomplete because required documentation and fees had not been provided.

The property’s owner, who spoke on behalf of JSC Group LLC, told the magistrate the general contractor and subcontractors are now handling the permit package and that the only outstanding item is final approval of the electrical subcontractor. “My GC’s done everything he can. The plumber’s done everything he can. So, now it’s just electrician,” the respondent said, explaining that the electrician prefers to submit through a third party called Same Day Permits.

Luke Curtis, building official for the city of St. Pete Beach, told the magistrate that fees had not been paid and that the permit is not “deemed complete” until fees and required documentation are received. Curtis said some supplemental packets arrived late and that review does not proceed until the permit is complete.

Noting the history of missed deadlines, Special Magistrate Knight said she would issue fines to motivate final action: “I am going to go ahead and issue a $250 a day fine until the property comes in compliance,” she told the respondent. Knight also ordered $330 in reasonable administrative costs and authorized any recording fees needed to affect a lien on the property; she said a written order will be mailed to involved parties.

The magistrate advised the owner to notify code enforcement once the permit is fully issued so the city can confirm compliance. The city’s action is limited to fines and administrative costs; any further appeals or reductions must be pursued through the city’s appeal process, the magistrate said.
