DuPont council adopts ordinance to align local code with state rules for EV fast-charging

On April 14 the DuPont City Council enacted Ordinance No. 26-1168 (second reading), amending multiple sections of Title 25 of the DuPont Municipal Code to align local definitions and land-use tables with state definitions for electric vehicle infrastructure.
Director Barb Kinkade told the council the amendments would change how electric vehicle (EV) infrastructure is classified in commercial, community-business and mixed-use districts—designating fast-charging EV infrastructure as a primary use where appropriate, rather than an accessory use. “Think of it like our new-age gasoline station,” Kinkade said, arguing that it is inconsistent with legislative intent to treat fast-charging stations as accessory uses.
The change also updates the Old Fort Lake subarea table and makes adjustments to the code chapter specific to electric vehicle infrastructure. Deputy Mayor Winkler moved to approve the ordinance; Council Member Elliott seconded and the council adopted the ordinance by voice vote.
Council members thanked Kinkade for her work on the comprehensive plan and noted the ordinance is part of broader land-use updates intended to reflect state law and support electrification infrastructure.
