The Silver Spring Township Zoning Hearing Board on April 13 unanimously approved a set of variances for Route 114 LLC to construct a multistory multifamily apartment complex with enclosed parking and on-site dumpsters at Sporting Green Drive and Bent Creek Boulevard in Mechanicsburg.
Chairman Donald Franklin presided. Attorney Thomas Nehilla and engineer William Swirenik of David Miller Associates presented the application on behalf of Route 114 LLC (successor by conversion to Route 114 Associates), and Zoning Hearing Officer Chelsea Leiby confirmed that the required legal notices were published and posted as required by law.
The board considered requests to waive multiple provisions of the Silver Spring Township Zoning Ordinance. The applicants sought relief from Section 211.D.1, which requires a minimum 25-foot separation between buildings on the same lot; Section 211.C, which requires accessory structures (the proposed enclosed parking structure) to be at least 25 feet from any property line; Section 211.D.3, which requires vegetative ground cover and a minimum 10-foot-wide landscape strip along property lines; and Section 211.D.4, which governs waste receptacles and requires dumpsters to be screened and set back a minimum of 25 feet from lot lines and 50 feet from adjoining residentially zoned properties.
Applicant representatives also testified that portions of the site are within a mapped floodplain and that design will comply with Federal Emergency Management Agency regulations; they referenced a Hydraulic Engineering Center-River Analysis System study conducted on the property to address floodplain impacts and compliance.
After asking questions and adjourning briefly to executive session for quasi-judicial deliberations, the board returned and Vice Chairman Richard Maffett moved to approve the application and requested variances; Board Member James Hall seconded the motion. The board approved the motion unanimously. The board did not receive any public comment on the application.
At the close of presentations members briefly discussed preparing suggestions to update the township sign ordinance for submission to the Board of Supervisors. Having no further business, Chairman Franklin adjourned the meeting at 7:00 P.M.
