Council advances camping ordinance amendment to align city code with recent Supreme Court ruling

The Joplin City Council on March 17 advanced a revision to the city’s parks ordinance that removes a requirement for law enforcement to check shelter-bed availability before enforcing camping prohibitions, a change staff said is necessary to align the code with a recent U.S. Supreme Court decision.
City Attorney Mr. Edwards told the council the amendment deletes the provision that formerly required police to check local homeless shelters regarding bed availability. "This updated council bill just makes our current ordinance consistent with that Supreme Court decision," he said.
Council members pressed staff on enforcement consequences and penalties. Council member Jackson asked whether repeat violations could lead to jail or other sanctions; Mr. Edwards said the municipal judge has discretion and typically applies a progressive approach, which can include fines or other court-ordered measures. The motion to advance council bill 2025-001 to second and third readings was approved; the chair recorded the motion as passing "8 in favor with 1 abstinent" in the meeting record.
The ordinance is at the code-amendment stage and will return for subsequent readings before any final adoption. The council did not adopt a final penalty schedule in this session; Mr. Edwards and municipal court practice determine case-by-case outcomes.
