Board delegates routine Title 5 local upgrade approvals to health director

The Tyngsborough Board of Health voted on June 8 to adopt formal procedures giving the health director authority to approve routine local upgrade approvals under Title 5, aiming to speed permitting for straightforward repairs and reduce applicants' time and cost.

Staff presented a draft policy modeled on practices used in neighboring towns that lists the types of requests the director may approve — for example, certain reductions to offsets for foundations or non‑sensitive site features — and those items that must come before the Board, such as reductions within 100 feet of a wetland, changes requiring abutter notification, tight tanks and any request in a Zone I public water supply area. The policy also includes a catch‑all so items outside the defined scope or raising concerns would be returned to the Board for review.

Consultants and board members said the delegation mirrors regional practice and preserves checks and balances: the director retains discretion to refer any uncertain or high‑impact matter back to the Board. Board members emphasized that abutter notification and public‑hearing requirements will not be removed.

After discussing edits — including adding a sentence under B7 clarifying that any issues or concerns deemed necessary by the director shall come to the board — the Board voted to adopt the procedures with that edit. The vote was unanimous among members present.

Board members noted the change should accelerate approvals for routine repairs at sale closings while retaining oversight for cases with potential neighbor or public‑water impacts. Staff will incorporate the agreed language and publish the updated procedure.
