Supervisors approve two rezoning cases and a final plat; floodplain and access conditions emphasized

The Dubuque County Board of Supervisors approved two zoning map amendments and a minor subdivision during its Feb. 17 meeting after planning staff outlined site conditions and neighboring land uses.
Ben Cobert, Dubuque County zoning administrator (speaker 8), said the Casey request would rezone about 1.99 acres to create a simple family division allowing the owner to retain the house while selling farm ground. The county zoning commission recommended approval on Jan. 20, he said. "On January 20, the Dubuque County Zoning Commission recommended approval of this rezoning case by a unanimous affirmative vote of the five commissioners present," Cobert told the board.
Surveyor Dave Schneider (speaker 5) said he represented the applicants and confirmed the proposal was a family division: "Basically it's just a family situation. Mom's gonna stay in the house. The kids are gonna own the farm ground together," he said.
Supervisors moved, seconded and approved the rezoning for the Casey trust and directed staff to enter the ordinance and amend the official zoning map and publish the amendment.
On the Parker case, Cobert described a ~15.115-acre rezoning from R1 to R2 to permit a minor subdivision (Parker Addition) creating two lots, one intended for new residential development. He warned that Massey Station Road frontage sits mostly in the 1% annual floodplain and recommended a condition that a floodplain development permit be obtained before any dwelling on Lot 2 is permitted. Cobert told the board the staff report includes a requirement that prior to obtaining a zoning permit for a dwelling on Lot 2 the applicant must obtain required floodplain permits, if any.
Supervisors pressed for clear memorialization of floodplain concerns in project notes so future boards and adjustment panels would have a record of the planning staff's concerns. Following discussion and a motion, the board approved the rezoning with the recommended conditions and suspended second-meeting requirements to adopt the amendment immediately.
The board also approved the final plat of Stoeckle Acres to create a 7-acre lot to be sold to a neighboring property owner; staff noted agricultural exemptions and contiguous acreage as justification for treating it as a minor subdivision.
The approvals include directions to the zoning administrator to annotate the official digital zoning map and to the auditor to publish the ordinance as required by law.
