At the Village of Wellington agenda review on Feb. 23, council members received briefings on multiple agenda items that will appear for formal consideration at upcoming public meetings, including a proposed land swap, authority to execute closing documents on Cape Park property, an annexation along Lake Worth Road and a sixth amendment to a purchase‑and‑sale agreement concerning a school parcel.
Land swap: staff described Resolution AC2026‑02 as a proposed swap with MH Wellington 2023 LLC involving a triangular parcel at South Shore and Pearson Road and the transfer of ownership of a bridal‑trail easement. Staff said the village would account for a value of approximately $200,000 in the exchange and that right‑of‑way and future intersection improvements were reviewed to avoid conflicts.
Cape Park closing authority: staff introduced Resolution AC2020 to name individuals authorized to execute a special warranty deed and related closing documents in favor of Wellington Property Owner LLC; staff said the measure would facilitate a future closing and does not itself complete the sale.
Annexation: staff summarized Ordinance 2026‑08 to annex a portion of the Lake Worth Road right‑of‑way in front of Panther Run Elementary School, explaining the annexation would extend village responsibilities for traffic regulation and maintenance pending geotechnical review and a county letter of no objection.
PSA amendment and school parcel: the sixth amendment to a purchase and sale agreement would allow Wellington Property Owner LLC (and related Ross parties) to assume purchase of a school parcel and permit termination of an existing agreement with EIM. Staff emphasized the amendment requires future land‑use approvals if the purchaser later seeks a non‑school use and that a market‑price payment would apply in that situation; council members clarified that the purchaser would not keep the school parcel at the originally discounted sale price if a higher‑value non‑school use is proposed.
Employment agreement: council members reviewed a red‑lined draft of the Village Manager's employment agreement and a salary comparability memo; changes were described as relatively minor and detailed questions were deferred to the formal meeting the next evening.
No formal votes: the agenda‑review session was informational and preparatory — staff will return to the council in the appropriate public hearing with presentations and supporting documents before any final votes.
