Council staff to issue formal written denial for Isle of Caroll rezoning after failed vote

Counsel briefed the Village Council on March 23 that state statute requires a written final order when a development request is denied, and staff recommended issuing that order for ordinance 2025-29 related to the Isle of Caroll/Polo residence rezoning.

Ms. Cohen said the statute “requires that when we deny a development order, we have to issue a written denial.” The council's earlier meeting had failed to approve the rezoning by motion, and members discussed whether that failure equated to a denial and whether the order should state the denial is “with prejudice” or “without prejudice.”

One council member said they remembered a motion to deny being made that night but stopped; another said the approval motion had simply failed. Counsel and staff stressed the written order must accurately reflect what actually occurred and include citations to the legal authority supporting the denial. The council asked staff to review the recording to confirm the council's intent before the order is finalized.

Separately, staff noted that broader state legislation discussed during the meeting (Senate Bill 180 and related amendments) has limited the council’s ability to pursue certain zoning changes in the future, and councilmembers agreed to revisit the item in more detail at a later public meeting if necessary.

Next steps: staff will prepare the written order that memorializes the council's prior vote and include the applicable statutory citations and council rationale; they will circulate it to council in advance of the meeting for confirmation.
