Commission recommends updates to substandard/dangerous buildings code, sends redline to council

The Building and Standards Commission reviewed redlined revisions to Article 3.12, which would update the city's substandard and dangerous buildings rules and align local language with the 2024 International Property Maintenance Code. Staff summarized the packet: "Most of what staff has put in is just additional, legal buffer to make sure that we're not, you know, in any gotchas," Jordan said. Commissioners debated whether owners, property managers, or other persons exercising control should be explicitly liable for compliance and how appeals should proceed if a property is condemned.

On the appeal question, staff and the council liaison said they would verify state law and the ordinance's language; several commissioners noted that if the commission's decision is final the owner's next available remedy could be to appeal to district court. Commissioners asked that any package presented for condemnation include a documented timeline of inspections, notices and certified-mail receipts so the commission can see that due process has been followed before a condemnation hearing.

The commission moved and seconded to recommend the redline revisions to Article 3.12 (property maintenance/substandard dangerous buildings) to city council with two small drafting changes; the motion passed unanimously.
