Staff told council the application for 21321 Paseo De Vaca was requested because a pool had been constructed into a drainage easement in a location that differed from approved plans; field inspection flagged the departure from the plans. Staff said the original plan approvals passed preliminary inspections but subsequent construction moved the pool into the easement and into setback area; a retaining wall will need to be rebuilt to code. Several council members described repeated problems with the contractor, noting previous building‑standards issues and calling for better contractor registration enforcement.
On resolution 26‑2195 (21321 Paseo De Vaca), Councilor Hall moved to table the item until the applicant applies for and the Board of Adjustment (BOA) approves any necessary variance; the motion passed 6–1. Council said staff will provide additional project history and work with legal counsel on the next steps.
Council then considered two lot‑consolidation vacations. Council approved resolution 26‑2196 (21301 Pioneer Cove) unanimously; staff said this was a routine lot consolidation with no existing structures. For resolution 26‑2197 (3505/3405 Boone Drive), members expressed concern after an inspector said a pool had been built on a vacant lot and that consolidation sequencing may have been misrepresented on survey documents. A motion to approve failed; council then voted unanimously to table the item to allow the homeowner or builder to appear and explain the timeline.
Throughout the discussion councilors repeatedly urged staff to tighten inspection and permit processes, to clarify what constitutes a "major violation" under the contractor‑registration ordinance and to provide a memo on potential enforcement steps. Staff said it will produce project histories and consider code changes as part of an ongoing code review.
