Franklin County Legislature adopts Open C-PACE local law and authorizes Energize NY agreement

The Franklin County Legislature adopted Local Law 1 of 2019 on May 16, 2019 to establish a Sustainable Energy Loan Program (Open C-PACE) and directed the Clerk to advertise the law, following a public hearing and committee review.
The local law enables property owners within Franklin County to access long-term financing for eligible energy efficiency and renewable energy improvements secured through a voluntary assessment tied to the property. Legislator Sherwin moved adoption and Legislator Ellis seconded; the roll call vote was 7–0 in favor.
The Legislature also authorized the County Manager, subject to review and approval by the County Attorney, to enter into an agreement with Energy Improvement Corporation to operate the Energize NY Open C-PACE financing program in Franklin County. The authorization directs the County Manager to execute the agreement consistent with the terms outlined in the local law.
County officials said the local law was placed on the May 16 agenda after a May 2 resolution set a public hearing. The Clerk was directed to publish the adopted local law as required by the Municipal Home Rule Law.
What happens next: the County Manager and County Attorney will complete the EIC agreement and the county will begin implementing the program under the oversight provisions established by the local law.
