Committee advances technical fix to protect local governments’ authority to provide benefits

Sponsor testimony explained that SB 1099 clarifies California law to explicitly tie state statute to the federal Personal Responsibility and Work Opportunity Reconciliation Act (PRWORA) exemption, reducing legal uncertainty for cities and counties that provide services to all residents.
Erin Evans Fudum, legislative deputy county counsel for Santa Clara County, and other municipal legal representatives said the bill provides legal certainty for existing programs such as street medicine teams, crisis hotlines and encampment outreach that operate with low barriers and sometimes without detailed intake or documentation.
Witnesses stressed the bill does not compel local agencies to change practices; instead it clarifies that providing certain state or local public benefits is permissible under federal law where the exemption applies.
The committee moved the measure to the Human Services Committee.
