Josephine County adopts resolution backing tobacco retail enforcement; one commissioner abstains

The Josephine County Board of Commissioners voted to adopt Resolution 2026-009 on June 9, 2026, a statement that affirms tobacco retail enforcement as the county’s primary approach to preventing youth access while maintaining adult consumer choice. The motion passed by roll call: Commissioner Richardson voted yes, Commissioner Martin abstained, and Commissioner Smith voted yes.

Commissioner Richardson reintroduced the proposal and noted county counsel had reviewed whether the resolution would affect county grants; counsel reported it would not. Richardson also read a letter the board had received from Richard Caseman, executive director of the Oregon Neighborhood Store Association, urging adoption and arguing enforcement coupled with retailer compliance helps keep tobacco out of minors’ hands while respecting adult decision-making.

Commissioner Vega used the discussion period to question age-based regulation inconsistencies in state policy, saying that the state’s higher purchase age for tobacco seemed inconsistent with lower ages of consent in other areas of law. Vega framed the resolution as nonbinding policy that expresses the board’s position rather than creates new legal obligations.

Before the vote, a board member disclosed a conflict of interest and said they would abstain from the decision. The board then moved and seconded the resolution and approved it by roll call. The board discussed posting the adopted resolution to the county website for public access.

Resolution 2026-009 will be posted by county staff and entered into the public records for Josephine County. The resolution is advisory in nature; the board did not attach regulatory penalties or new enforcement mechanisms in this session.
