Town Counsel Brian Bertram briefed the board on the town’s draft language for the special act concerning Katama Fish (packet reference H5347/H.5084). Applicant Patrick Ross and counsel Adam Barnowski said the draft preserved a non‑transferable license, clarified the licensed location, and included a provision that if the business ceases operation the license would return to the town and could be reissued at the same location within a three‑year window before it sunsets. "The draft sufficiently honors the town vote and the non‑transferable license," Barnowski told the board.
After discussion, Select Board members moved and voted to accept the legislative language as written and to have counsel inform the town’s legislative liaison that the board concurs, a roll‑call motion that passed unanimously.
Separately, attorney Arthur Pearl appeared on behalf of Jesus Patel and H&J Convenience, asking the board to file proposed special‑legislation language to authorize an all‑alcohol off‑premises license at 365 Barlo’s Landing Road. Several board members said they preferred language consistent with the Katama Fish draft — limiting transferability to the location and including a three‑year window for reissuance — and asked Counsel to draft the suggested change and bring the edited language back at the board’s June 30 meeting for final action.
