The McAllen City Commission voted to table a variance request for a small subdivision at 2201 South Benson Road after several commissioners expressed concern that adjacent property owners had not been adequately informed about possible changes to right‑of‑way alignment.
Staff summarized the developer’s request — three variances relating to right‑of‑way dedication, cul‑de‑sac dimensions and sidewalks — and noted the planning and zoning commission recommended approval of variances one and three but disapproval of variance two. Commissioners questioned whether the standard notice given under state law meaningfully explains potential outcomes when a developer proposes shifting a collector right‑of‑way from the middle of a parcel to an adjacent property line.
"It does seem like that is a notification and a possible opportunity for that adjacent property owner to comment before we set it in motion," one commissioner said during the discussion, urging improved transparency. Staff acknowledged the statutory notice requirement but agreed to examine whether additional language or an informal outreach step could help adjacent owners understand possible consequences.
Because of these concerns, the commission made and approved a motion to table the item so staff can consult on notice language and contact the affected adjacent owners, and return with options for improving transparency when variances affect neighboring parcels.
Next steps: staff will review notice procedures, consider additional outreach to the adjacent property owner, and bring a revised recommendation back to the commission.
