Under the draft, the village would pay the first $500 of consultant costs for appeals brought by neighbors; if projected costs exceed $500, escrow deposits would be required from both the appellant and the property owner and costs would be split to reimburse village invoices.
The attorney and staff said the current code requires a $1,000 escrow from a neighbor and then leaves subsequent consultant costs to the village without a cap, which can place significant expense on taxpayers. The draft seeks to lower the upfront burden for neighbors while capping village exposure and requiring cost-sharing on protracted or expensive matters.
Several trustees said $500 sounded low given today’s consultant rates and suggested increasing the village’s initial absorption or seeking other communities’ models; one trustee proposed $5,000 as a possible alternative. Staff said there is no urgency to adopt the change and recommended further research and a revised draft prior to any public hearing.
