Harwinton zoning commission continues regulation review, flags need for data-center definition

The Harwinton Zoning Commission on June 8 resumed its review of the town zoning regulations dated July 1, 2025, picking up with Sections 3 and 4 and scheduling continuation beginning with Regulation 4.6 at the next meeting. Commissioners discussed whether the general rule in Zoning Regulation 1.3.1 — that any use not specifically permitted is prohibited — means the regulations should not also list specific prohibited uses, or whether both approaches can coexist in the code.
Members noted the regulations currently list specific prohibitions, including Medical Marijuana Dispensary Facilities and Production Facilities and Recreational and Hybrid Cannabis/Marijuana Establishments. Commissioners also discussed accessory dwelling units, referencing PA 21-29 (2022) and the town’s authority to address ADUs, and agreed to review Home Occupation and Professional Office standards for clarity.
The commission identified a gap: the regulations lack a definition for "Data Centers." Land Use Coordinator Polly Redmond said she would draft proposed definitions and other changes for future meetings. No formal vote or regulatory change occurred at the June 8 meeting; the review will continue at the next zoning meeting starting with Regulation 4.6.
