Gulf Shores council conditionally vacates 1.37 acres of Gulf Avenue right-of-way to First Baptist Church

Councilman Jason Dyken, M.D., moved to adopt Resolution No. 7129, which conditionally declared the vacation of the right-of-way; Councilman Stephen E. Jones seconded the motion, and Mayor Robert Craft declared it carried with Councilmembers Jennifer Guthrie, Philip Harris, Jason Dyken, Stephen E. Jones and Mayor Craft voting "aye." Councilman Joe Garris, Jr. was absent.
At a subsequent hearing required under Alabama Code § 11-49-6, the council adopted Resolution No. 7130 to determine fair market value and to fix the vacation fee. Under the resolution, the vacation fee will be satisfied by conveyance of specified parcels (Parcel A and Parcel B) from First Baptist Church to the City; the resolutions describe the parcels and reference the required public-notice procedure. Councilman Philip Harris moved adoption of Resolution No. 7130; Councilman Jason Dyken seconded the motion and it passed by the same recorded vote.
Resolution No. 7131 authorizes the Mayor and City Clerk to execute a Quitclaim Deed conveying the described portion of the right-of-way to First Baptist Church once the required conveyance and documentation are received and approved by the Mayor. Councilman Jason Dyken moved adoption of Resolution No. 7131; Councilman Stephen E. Jones seconded, and the motion carried.
The council's action is conditioned on completion of the in-kind property transfer and required documentation; the resolutions preserve the council's right to require forms and amounts consistent with state law before the conveyance becomes effective. No written objections to the vacation were reported at the public hearing.
The council made no changes to the legal descriptions presented in the resolutions; the vacation area is described in the record as approximately 59,622.4 square feet (1.37 acres). The matter will return to the city when the conveyance and related documentation are presented for execution.
No members of the public offered written objections at the hearing; the City Clerk reported advertising and departmental review were complete.
