Commission moves flying-communities provisions to BOCC after cleanup and debate

The Marion County Land Development Regulation Commission voted to advance proposed regulations for “flying communities” — residential or mixed-use developments with legal taxiway access to a private airport — to the Board of County Commissioners with staff corrections and the deletion of a redundant subsection.
Ken (S7) summarized the proposed Section 4.3.0.28, which would apply the PUD process and tailored standards to flying communities and address compatibility (buffers, landscaping, open space) and site-specific items such as mass grading and amenities.
During public comment, Bizzy Shires (S8) of Horse Farms Forever asked the Commission to limit accessory aircraft hangars to 30 feet in height and proposed listing lawfully established or vested flying communities that predate the ordinance so those communities would be identified in the code. Dirk Leibert (S10) said the newly coined term “flying community” inadvertently altered other code sections and urged staff to clean up cross-references before county adoption.
Commissioners discussed height limits (50 ft vs. 30 ft), grandfathering/vested-rights language and whether the county should compile a list of vested developments. Staff (S9) cautioned against enumerating specific communities in the code, pointing to the existing process for vesting letters. The Commission directed staff to prepare cleanup language and to bring the package to the BOCC public hearing; a motion to move the language as edited (including deletion of section b) passed with three votes in favor and one abstention.
The item will appear at the BOCC public hearing; the LDRC noted a separate cleanup action would be prepared to align other code sections with the new definitions.
