County staff: Nest bakery’s seating expansion under review; notice deadline extended to March 2, 2027

County planning staff updated commissioners on a pending request by the bakery referred to in the packet as "the Nest." The staff briefing said the business has a conditional-use application under review and has requested to expand seating; staff noted they have not received a variance application or fee-waiver request from the applicant.

Staff reported the applicants granted a 215-day extension. "The applicants did grant an a 215 day extension, so now our deadline to issue the notice of decision will be 03/02/2027," the staff member said. The staff member also explained that conditional-use permits are reviewed by staff rather than the board; if a conditional-use determination is appealed, it proceeds to a hearings officer, and only further appeals would come to the board.

Commissioners asked for clarification in public communications about the nature of the review so constituents understand the board is not currently deciding to revoke or halt operations; staff pointed to an FAQ they circulated to help correct public misunderstanding. Commissioners also discussed the ability of applicants to request a fee waiver and whether payment must be made before the waiver is considered; staff said either approach is allowed (applicants may submit the waiver request first or submit the fee and have it held pending the board decision).

Next steps: staff will update the FAQ and the county website with current information. If a variance or a fee-waiver request is filed and then appealed, the hearings officer would hear the appeal; only after a hearings-officer decision and subsequent appeal would the board review the matter.
