Commission raises carport setback questions; unanimously approves minutes and a home permit

The Levan Planning Commission discussed corner‑lot carport setback questions raised by the Huntsman family and agreed further review of the town ordinance is needed.

A commission member presented the inquiry: the Huntsmans wanted to know whether they could install a carport over their driveway on a corner lot without submitting a permit first. Building Inspector Lane said the state building code does not subject open‑sided structures (open on three sides) to standard setback requirements, a rule that also applies to porches. Commissioners noted the town ordinance addresses covered porches and limits how far such structures may extend from the main building (approximately 20 feet) and said the ordinance’s apparent intent is to prohibit a roof structure that extends beyond that threshold. Chair Nathan Washer said he would likely deny a permit for a carport that extended beyond the 20‑foot limit and recommended revisiting the ordinance language; the commission said a public hearing may be required to change policy.

On procedural business the commission corrected an agenda error (the minutes under consideration were from Dec. 3, 2025, not October) and approved the Dec. 3, 2025 regular meeting minutes on a motion by Rachel Goates, seconded by Carol Bennett; the motion carried unanimously. The commission also approved a permit application for a new home by Keigan Smith after staff confirmed setbacks, wastewater permitting, and building‑inspector sign‑off; Carol Bennett moved, Rachel Goates seconded, and the motion carried unanimously.
