The Scott County Board of Zoning Appeals on June 10 approved a variance allowing Ben and Sherry Petty to build a 650-square-foot handicap-accessible attached unit intended for a mother-in-law who has lived with the family for two years.
Ben Petty described the proposal to the board, saying, "what me and Sherry's want to do is we're calling at a cottage for my mother-in-law. She's been living with us for 2 years. She can't live on her own." He said the property is about 15 acres and has more than 300 feet of road frontage.
Board and staff questioned infrastructure matters including septic and sewer connections; Petty said the property’s septic/sewer arrangements were being addressed. No letters or public comments opposing the proposal were reported during the public portion, and the board closed public comment before deliberations.
A motion to approve the variance was moved and seconded; the chair reported the motion passed following affirmative confirmation, with four votes in favor. Staff instructed the applicants on next steps and permitting requirements.
The board did not reference any statutes or codes by citation during the discussion. The applicants and staff were asked to follow up with the planning office on septic/sewer confirmation and building-permit steps.
