Board hears update on Regional Way connection and triparty agreement tying development approvals to roadwork

Township staff and board members spent substantial time on June 9 updating the board on negotiations around a triparty/CRP amendment and the Regional Way connection tied to multiple development projects.

Staff summarized a compromise in which developer protections (refund provisions) were removed from the CRP agreement but certain timing and completion conditions were preserved; the Hillwood occupancy condition would lift after either a temporary or permanent Regional Way connection is established. Board members pressed staff and developers on who would be responsible for completing the connector work, the risk of removing refund provisions, and how liquidated-damages or leverage would affect developer timelines.

Outstanding prerequisites identified in the discussion include utility relocations, a Chapter 105 permit for stream work, execution of deeds of dedication, and release of lender liens on affected properties. Staff said some original deeds were in hand but legal descriptions (for Exit 26, for example) and lien releases remain unresolved. The board and staff agreed that conditional approval with contingencies is possible but several supervisors preferred to wait until outstanding exhibits and lien releases are complete before final sign-off.

Staff indicated that, if the outstanding utilities and permit items are resolved in the coming weeks, the CRP amendment and related documents could be ready for execution at next month’s meeting; otherwise the board would delay final approval until those contingencies are satisfied.
