Montville authorizes conservation easement and deed actions tied to Brookside development; resident voices concerns

The Montville Township Committee on May 26 authorized execution of a Conservation Restriction/Easement, a Deed of Transference for a portion of River Road, and a Deed of Age Restriction related to the Brookside development (property owned by Diversified Properties, LLC d/b/a DP Brookside, LLC). The Township Attorney reviewed and approved the documents for execution and recording; the Mayor and Township Clerk were authorized to execute the Deed of Conservation Restriction/Easement.
At the meeting the Committee also approved Resolution 2026-217, an addendum to the April 24, 2026 Agreement with Dan Como and Sons, Inc. for removal of organic materials from Block 123, Lot 24 (96 River Road). The addendum authorizes Como to remove "finished compost" from the property at no cost to the Township under the same terms as the original agreement; the Administrator is authorized to take steps necessary to effectuate the amendment.
During public comment, resident Holly Cox (1 Dey Court, Towaco) reiterated displeasure with the Diversified/DP Brookside project, saying it has adverse effects on wildlife and that she felt disrespected by how the Township settled with the developer. Cox also urged greater investment in the First Aid Squad and criticized the practice of not reading emailed comments into the public record; she recommended reading only resident emails and requested a virtual meeting option. The Township Attorney clarified that the Diversified settlement matter was discussed in closed session. Pat Gamsby (102 Hook Mountain Road) asked about Ordinance 2026-16 and thanked the Committee for planned safety signage near a dangerous curve by her property.
The resolutions related to Brookside and to organics removal were adopted as part of the consent agenda and take effect immediately. The minutes do not record settlement terms discussed in closed session.
