The Board of Public Works and Safety on May 26, 2026 denied a request from resident Dion Winn to adjust his wastewater bill for 931 West Votaw Street and also denied a request to waive penalty fees applied after a late payment.
City Attorney Wes Schemenaur told the board that the city's ordinance allows a sewage adjustment only when the leak occurs between the meter and the foundation of the home or building. Schemenaur said Mr. Winn's leak was under the home and therefore did not qualify for an adjustment under that ordinance. The board recorded that it sympathized with Mr. Winn's situation but that the ordinance required denying the request.
The board also considered Mr. Winn's request to waive penalty fees. The city recorded that his payment was received one day after the due date; in keeping with the ordinance, penalties are applied the day after bills are due. The board voted to deny the requested waiver.
Both motions were made by Jerry Leonhard and seconded by Steve Mcintosh; the meeting record notes the chair voted aye on both motions. The minutes do not show a roll-call tally of each member's vote in the transcript provided.
