Upper Milford supervisors approve lot-line adjustment, extend winery deadline and authorize $228,936.58 escrow release

The Upper Milford Township Board of Supervisors met Sept. 15, 2022, in Old Zionsville and unanimously approved several land‑use and administrative measures, including a lot‑line adjustment for John and Annabelle Fegley, a 365‑day time extension for O'Rourke Winery land development, and a $228,936.58 partial escrow release for the Estates at Maple Ridge subdivision.
Supervisor Joyce K. Moore moved to approve the Sept. 1, 2022, meeting minutes and to pay the listed bills; Supervisor John D. Zgura seconded both motions and the board voted in favor. The board approved General Fund checks 21541–21572 for $96,849.14, Street Light Fund check 1382 for $2,269.01, and Escrow Fund check 169 for $6,214.14.
Planning Coordinator Brian Miller told the board the Planning Commission recommended approval of a boundary line adjustment for property owners John and Annabelle Fegley on Kings Highway North, contingent on standard recording items: forwarding temporary and final deed descriptions, setting and certifying survey pins before plan recording, and noting zoning variance approval on the record plan. The minutes note the applicant received a favorable Zoning Hearing Board decision on Article 3, Section 313.C.12.b.(ii) (accessory structure side‑yard setback). Supervisor Moore moved to approve the lot‑line adjustment per Miller’s Sept. 14, 2022 letter; Supervisor Zgura seconded and the motion carried unanimously.
An email from Elizabeth O’Rourke requested a 365‑day extension to complete land development at 6501 Saint Peters Road (O'Rourke Winery). The board granted the extension to Oct. 15, 2023, on a motion by Supervisor Moore and second by Supervisor Zgura.
Township Engineer Jeffery Ott certified that construction improvements for the Estates at Maple Ridge had progressed to permit a partial reduction of financial security. The certification authorized Penn Community Bank to release $228,936.58 while requiring the escrow fund not be reduced below $2,511,511.27. The board approved credit release No. 2 for that amount; the action was moved by Supervisor Moore, seconded by Supervisor Zgura, and carried.
The board also approved a request from Old Zionsville United Church of Christ for Special Fire Police assistance on Dec. 24, 2022, from 7:00 to 7:45 p.m., contingent on availability of Vera Cruz Fire Company units from stations #19 and #28. The request was submitted by Kathy Latshaw and approved by unanimous vote.
Several standard reports were recorded as having no activity, including the solicitor’s report, Emergency Services Committee, and reports from local fire companies and the Recreation Commission. Resident Jim Krippe raised a question at the end of the meeting about the location of future meetings and acoustics for participants joining by Zoom; Supervisor John D. Zgura noted a prior decision to continue meetings in the larger meeting room.
The meeting was adjourned at 7:14 p.m. and the minutes were signed by Chairman Daniel J. Mohr and Secretary Jessi O’Donald.
