Covington council deadlocks on interim District 2 appointment; court to decide

The Covington City Council on April 21 failed to appoint an Interim District 2 Council Member to fill the unexpired term of the late Mayor Fred F. Forbes III after a roll call vote produced no candidate with the three votes required for appointment.
Mayor Raymond C. Hunter opened the called public meeting at 6:30 p.m. in the Council Chambers and confirmed the presence of Councilwoman Susan S. Crowder, Councilman David B. Goff and Councilwoman Susan S. Wolfe. Mayor Hunter announced the applicants as Michael Green, Milton Helton and Gene Mundy.
City Clerk Amber N. Berberette explained the voting procedure and conducted a roll call that produced the following individual votes: Councilwoman Susan S. Crowder voted for Gene Mundy; Councilman David B. Goff voted for Michael Green; Councilwoman Susan S. Wolfe voted for Gene Mundy; and Mayor Raymond C. Hunter voted for Milton Helton. Berberette announced the tally as Michael Green 1, Milton Helton 1, and Gene Mundy 2 and said that, because no candidate received at least three votes, Council did not appoint an interim member.
Berberette also told the meeting that “the individual appointed would not be eligible to participate in Council actions, vote, or be appointed to boards or commissions until taking the oath of office with the Alleghany County Clerk of the Circuit Court.” She noted that, under Code of Virginia § 24.2-228, if Council cannot make an appointment the Alleghany County Circuit Court will make the appointment.
After the roll call, Councilwoman Susan S. Wolfe moved to adjourn; Councilwoman Susan S. Crowder seconded and the motion carried with all members voting “aye.” The meeting minutes were signed by Mayor Raymond C. Hunter and respectfully submitted by City Clerk Amber N. Berberette.
Because the council did not reach the required majority, the next formal step is for the Alleghany County Circuit Court to fill the vacancy under the referenced state statute.
