Utility committee directs staff to draft ordinance to clarify reimbursement code

The Town of Silverton Utility Committee on Sept. 10 directed staff to draft an ordinance to reconcile inconsistent infrastructure reimbursement language currently scattered in the municipal code.
Clay Bookner, a town staff member, presented a memo that compared the town’s existing reimbursement language across multiple code sections and recommended either consolidating the language in one place or deleting duplicate provisions. Bookner told the committee he found the current code vague and “prone for error” and urged the town to rely on project‑specific development agreements or similar documentation rather than an informal repayment scheme.
The committee discussed regional examples. Bookner said the draft language is modeled in part on policies used by nearby towns such as Ridgeway and that approaches used by Durango did not serve their needs. Committee members agreed the intent should be to make the rules administrable and enforceable.
The committee agreed by consensus to ask staff to prepare an ordinance that would apply consistent reimbursement language to both the streets and utilities sections (chapters 11 and 13) and to present that ordinance to the trustees for consideration at a future meeting. The final ordinance text and chapter mapping were left to staff to prepare.
Next steps: staff will draft the ordinance language, delete or consolidate the existing provisions named in the memo, and bring the ordinance forward to the full board for consideration.
