The Westport Zoning Board of Appeals on Wednesday accepted a request to withdraw an administrative appeal for property at 0 Horses Neck Road without prejudice.
Robert Haynes, the petitioner, read a written request asking to withdraw the petition "regarding the property located at zero horse neck road currently pending before the zoning board of appeals without prejudice." Vice Chair Kazaki and other board members discussed the withdrawal and its consequences during public session.
Attorney Blake, the board’s counsel, said the committee was not certain an appeal of a withdrawal would be viable and that the remedy on any hypothetical successful appeal was unclear. Vice Chair Kazaki noted that a withdrawal without prejudice allows the applicant to return to the board later; the board also reminded participants there is a 20‑day period in which the board’s action may be appealed.
After brief discussion, a board member moved to accept the withdrawal and the motion passed. The board recorded that the standard 20‑day appeal period applies following its action.
The board then moved on to other agenda items. The withdrawal leaves the petitioners free to refile in the future; any interested parties retain the right to seek judicial review within the statutory appeal period.
