County staff propose revisions to alcohol and zoning definitions; clarify event exemptions

County staff reviewed a package of proposed ordinance changes on March 18 intended to align local code with state law and to close gaps related to special events and caterers.

The proposed definitions include an "alcohol beverage caterer" add-on license for retail dealers and restaurants that transport and sell alcohol at off-premise, catered functions; a definition of "convenience store" and "general merchandise store" keyed to a gross floor area threshold (10,000 square feet) and a limitation that alcohol-dedicated floor area not exceed 15 percent of gross floor area. Staff said they will correct a remaining mismatch in the draft language before the public hearing.

Staff also distinguished between "farm winery" and a non-farm or regular winery for zoning purposes, and noted special provisions for brewers drawn from state law, including limits staff cited for off-premises sales per person and an annual production cap the staff said comes from state statute. Staff framed these as efforts to make the county ordinance consistent with state licensing categories and to provide rules for caterers and special-event alcohol sales.

On the scope of county-sponsored events, Parks & Recreation staff asked whether the ordinance's exception for county-sponsored events would allow alcohol sales at a county-sponsored Arts & Jazz festival at Veterans Park. Staff and legal counsel-style commentary in the session concluded the exception is an exemption to the local prohibition when the event is clearly sponsored by the county; staff proposed an annual advisory-board review to permit the festival and manage liability.

The board scheduled the items for a public hearing; staff said they would update and correct the draft ordinance text before the hearing.
