The Yancey County Board of Commissioners voted unanimously on May 11 to authorize steps needed for conveying the county-owned Parkway Playhouse property to Parkway Playhouse of Burnsville, Inc., a North Carolina nonprofit that has leased the facility for many years.
County Attorney Donny Laws presented a resolution that references the required notice procedures under N.C.G.S. 160A-267 and the conveyance authority in N.C.G.S. 160A-279. The resolution authorizes the county manager to execute a special warranty deed upon satisfactory compliance with statutory notice requirements and the inclusion of covenants and conditions. The deed language included in the appendix specifies that use of the property must be for athletic, artistic, literary, dramatic and/or educational purposes and that programs should be available to the general public and the local school system.
The board approved the resolution on a motion by Commissioner Mark Ledford, seconded by Commissioner David Grindstaff; the action was unanimous among attending commissioners.
Why it matters: Conveyance will enable the nonprofit to pursue funding and capital improvements to maintain and improve the Playhouse while the deed covenants aim to keep the property dedicated to public-serving uses.
