Brielle council urges defeat of proposed S-1836, citing threat to local land-use control

The Brielle Mayor and Council on May 11 unanimously approved a resolution urging state lawmakers to defeat Senate Bill S-1836, saying the proposal would undermine local land-use planning.
Councilman Colon introduced the opposition during the consent-agenda discussion, saying the bill "empowered religious organizations and non-profits to ignore local zoning when constructing affordable housing units." He urged public participation; resident George Mervine asked where to send comments and Councilman Colon said he would provide contact information.
Councilman Shaak added that local officials "would vote against this legislation" and noted that some local nonprofit properties already carry deed restrictions limiting uses to emergency services. The resolution, moved by Councilmember Visceglia and seconded by Councilmember Shaak, directs that copies be forwarded to Senator James Holzapfel, Assemblymembers Paul Kanitra and Gregory McGuckin, Governor Mikie Sherrill and the New Jersey State League of Municipalities.
The council recorded the vote in the resolution certification; the resolution frames S-1836 as "an egregious assault on municipal autonomy and local decision making" and states the borough's preference that projects participate in the local planning and zoning process.
