Giddings council amends code to allow permitted alcohol sales and consumption at city park events

The Giddings City Council on May 11 adopted Ordinance No. 923 to amend Section 1.10.064 of the Giddings Code of Ordinances to allow the permitted sale and the possession and consumption of alcoholic beverages by individuals at designated areas of permitted public events in city parks.
Interim City Manager Heather Garner said the amendment exempts permitted vendors and defined consumption areas from the general prohibition on alcohol in city parks, but requires compliance with applicable federal, state and local laws, including the Texas Alcoholic Beverage Commission (TABC). The ordinance allows the city to impose reasonable conditions on a permit or license, such as restrictions on location, hours, designated consumption areas, security requirements and insurance, and it prohibits removing alcoholic beverages from designated consumption areas.
Council adopted the ordinance by motion; the vote was recorded with ayes from Alan Casey, Mark Muniz, Kevin Rinn and John Dowell. No councilmember recorded a nay on the ordinance. The amendment restores permitting discretion to the city for future public events in parks where alcohol sale or consumption is proposed.
Staff and the council did not specify any immediate events that will use the new authority; any event organizer seeking to sell alcohol must obtain the city's permit and comply with TABC and other applicable rules before sales begin.
