The commission approved the MJ-2026-3 request unanimously (7–0).
The longer discussion centered on DW-2025-34, a request for multiple design waivers for a proposed five‑lot subdivision on about 9.18 acres. Applicant representatives asked the commission to waive several Unified Development Ordinance (UDO) requirements, including minimum common-area widths, tree-plot widths, corner rounding, and external pedestrian-network obligations, arguing the parcel is rural, lots are large (about an acre or more), and sidewalks or common areas would be impractical. The applicants said wells and septic systems were anticipated to serve the lots and that an adjacent developer is constructing Alexander Road, which would provide future public‑road frontage.
Staff and county legal counsel recommended removing the waiver that would excuse frontage onto a completed public street from the motion presented that evening. Applicant representatives told the commission they would not record any secondary plat until the county had installed and accepted the public roadway. As the applicant stated, “we will not record any secondary plat without that public roadway being installed, inspected by the county and as part of their ordinary course accepted for public use.” (Presenter)
A public commenter, Steven Samberg, identified himself with a Lake Eliza address and raised drainage concerns tied to the local conservancy district, saying older drainage pipes serve the area and describing one pipe as decades old and failing. Staff deferred technical drainage follow‑up to the county stormwater office and noted prior county work elsewhere in Lake Eliza to address historic problems.
Commissioners pressed applicants and staff about long‑term implications if sidewalks or other pedestrian features were waived now and the road network later extended to adjacent development. Staff noted the county holds a bond securing construction of Alexander Road and said the bond timeline in the record requires the work to be complete by Nov. 11 of this year; if the bonded developer fails to finish the work the county can call the bond and complete the road. After debate the commission approved the set of requested design waivers with the explicit removal of the UDO §7.16 waiver (public‑street frontage) by a 6–1 vote (Craig Kenworthy opposed).
